johnv, my car has been damaged while parked, I WILL be taking legal action but what I need to know is, If I repair it myself, before any claim is settled, will it complicate matters. Going to go by the small claims route, I have taken pictures of all the damage and I will get 2 quots tomorrow. Many thanks in advance, Waders.

I'd take comprehensive piccies of the damage done together with a current newspaper held up in the photo as proof of damage personally.

hi to waders. sorry to hear of you car being damaged. you are entitled to carry out your repairs yourself, AND CHARGE FOR THEM. Some people thing that if you do the repairs you can't charge but you can. My next door neightbours on the other side of the road his neightbour had some tiles come through the conservatory roof and he did the repairs himself. The insurance company company at first did not want to pay, but the person stated his time was valuable and he was entiltled to be paid. They paid up. But I had this myself, some water came through from the house next door because their ball valve struck up in their loft and they had no overflow pipe. Because I did the repairs myself they only wanted to pay for the materials and not my labour. They had to pay and they did. But you are saying you want to do the repairs yourself straight away. Course you can, just take all the photos you need and proceed. no need to have to wait. So want happened them. Was you car damaged by another car. or was it vandal damage.

that bit about a newspaper with the date on. one idea yes. most cameras nowadays have a date and time stamp on it wether digital of 35mm. --------------------------------------------------------------------- so why you going to court. is the person saying he did not do the damage. or just saying i am not going to pay full stop

O NO, NOT THAT AGAIN! Don't forget if your property is damage, never mind if it is a car, can be anything, by someone else. you are entitled to be in the position you where in before the event. Take me, so I got a car insured value £3000 so someone damages it and I was no way involved. So the repairs are going to cost £4000 but the book price for the year and model of my car is £1500, So they want to give me a cheque for £1500. I will tell them get lost, I want £4000. plus my expenses such as travel, telephone calls, lost of interest on my money if I have to pay out first before I am paid. etc. etc. cost of hiring replacement car. How can I say it any more clear. Say a person had a old vintage car or the like. and it was damaged by someone else. to say that its an old banger therefore I just offer you the scrap value is stupid. You would be entitled to the cost of restoring it to its former glory.

I sincerely hope you sort it in the end mate. I'm currently sorting out an ex-gypsy boxer hard as f*k neighbour of mine who's kid crashed his new xmas mountain bike into my brothers focus causing £300 quids worth of damage (quoted)... gonna get messy.

now that bit about a ex-gypsy boxer. That's is a real bad and un-lucky position to be in. All i can say is that at the moment, its not a Police matter until the damage was done on purpose. But the moment he touches you then it is a Police matter. still it not very pleasant having to deal with someone who gets nasty, if he does. I hope you get it sorted without to much hassel.
